Erick Bairnals Shcks technical and administrative staff of the Panama Maritime Authority raping a Filipina Pamela

A Panamanian embassy official accused of raping a Filipina finally broke his silence, as he claimed that what happened that night was consensual sex and not rape.

Erick Bairnals Shcks, a member of the technical and administrative workers of the Panama Maritime Authority, told Yahoo! Southeast Asia in a very phone interview Friday that he didn't force the alleged victim, tagged as “Pamela”, to possess sex with him.

“She never acted like she doesn’t wish it,” said Shcks, who already flew to Panama last week.

Under Article thirty one of the Vienna Convention on Diplomatic Relations, Shcks, as a politician of the embassy , enjoys diplomatic immunity. He was detained for every week however was released following a certification issued by the Department of Foreign Affairs relating to his immunity.

Shcks, a lawyer by profession, claimed he was willing to endure trial however was declared persona non grata, so was forced to go away the Philippines.

His version of the story
Shcks said he met “Pamela” at a language college in Manila. He said they went on a date and told “Pamela” to simply decision him if she wished to check him once more. He claimed that 2 days once they met, it absolutely was “Pamela” who initiated another meeting.

“She looks like a pleasant woman. I don’t have a cellphone then therefore I gave her my landline, and told her ‘if you would like to, call me, if you would like to check me again’,” he said.

On April twenty three, Shcks said Pamela known as him and urged a dinner date, to that he agreed. He said that once the dinner, they visited a bar where “Pamela” supposedly ordered Martini.

“There, we talked. She started hugging, kissing me. Then we tend to said it’s an ordinary place. I told her, let’s visit my place, there's one thing to drink, i need you to understand where I live (sic),” Shcks relates. “I was terribly inquisitive about the woman. i actually liked her at that moment and he or she agreed to travel with me.”

Shcks said “Pamela” created some calls whereas on their thanks to his unit. They later got wind of his place “very happy, hand at hand, not drunk, not drugged (sic),” he said.
“She agreed to travel by herself. If this is often rape, if the woman is afraid and if she must escape, she will be able to escape,” he said.
At his apartment, Shcks said: “Inside the space, we tend to listened to music, kissed one another, visit bed (sic). She acted like an experienced person,” he said, noting that “Pamela” left his unit past one am, aware and not beneath the influence of medication.

Video proof
Shcks has come back up with many CCTV footage showing him and Pamela arriving at the condominium lobby, kissing at the elevator, and Pamela leaving the building “happy.”
Yahoo! Southeast Asia obtained copies of the video however is refraining from posting it because it can reveal Pamela’s identity.

Was it ‘date rape’?

Pamela’s counsel, DJ Jimenez said his consumer was a transparent victim of “date rape.”

“Binola bola siya na might ipapakita lang siya sa condo niya tapos ayaw na siya palabasin [She was deceived to travel to his condominium and was prevented from going out]. this is often a case of date rape… she didn’t enable him to possess sex along with her,” said Jimenez.

Jimenez said his consumer was drawn to Shcks as a result of “he perceived to be intellectually partaking.” And though she voluntarily went on a date with him, it “is not license to possess sex.”

“The bottom line is kahit asawa, ang sex hindi pwedeng pilitin [You cannot even force your own spouse or else which will be rape],” Jimenez added.

“Makati court found probable cause to charge him. That already shows there's basis,” he noted, adding that Shcks' move to unleash the video is an “effort to discredit Pamela.”

Under Republic Act 8353, rape is punishable with reclusion perpetua or life imprisonment.
